Terms of Service

These terms are the agreement between you and Advection Software LLC (Wyoming, USA; “we”, “us”) for using the AudioTales app and this website. By using AudioTales you accept them. Our privacy policy explains how we handle your information.

1. Who can use AudioTales

You must be at least 18 years old, or the age of majority where you live if that is higher, to use AudioTales. Children may listen to books with you or with your permission, but they may not create, manage or use an account themselves. You're responsible for how the app is used on your devices.

2. What AudioTales does

AudioTales reads the words on photos of book pages that you provide, and makes a narration of them with a synthetic voice, optionally translated into another language and with background music. We may add, change or remove features over time.

3. Your books, and what you may do with them

• Books you own, for your household. Use AudioTales only with books you own (or are otherwise entitled to use this way), for private listening by you and your household. The audio and text it makes are for that private use only.
• No sharing or selling. Don't copy, distribute, publish, broadcast, sell, rent or publicly perform the books you photograph or the narrations, translations or exports AudioTales makes of them, and don't use AudioTales to build a collection of books you don't own.
• You keep your rights. You keep whatever rights you have in what you upload. You give us a limited permission to store, copy and process it — including through the service providers named in our privacy policy — only to provide AudioTales to you. It ends when you delete the content or your account.
• Your responsibility. You're responsible for the content you upload and for having the right to use it. Upload only pages of books; don't upload anything unlawful, or anything that infringes someone else's rights.

If you believe your copyright is being infringed through AudioTales, write to support@tales.audio with the details and we'll act promptly, which may include removing the material and closing accounts that repeatedly infringe.

4. Your account

The app creates an account for you automatically the first time you open it, without asking for your name or email address. Because that account isn't linked to an email address, signing out or removing the app ends your access to it, and we may not be able to recover the books in it. Keep your device secure: anyone who can open the app on it can use your account.

5. Plans, credits and subscriptions

• Narrating, translating and some other features use credits. The app shows your balance and what you've used.
• The free plan adds credits each month. Subscriptions, where offered, add a larger monthly allowance.
• Credits are valid for three months from the day you receive them — even if you cancel your subscription. After that they expire.
• Credits have no cash value, can't be transferred or exchanged, and can't be refunded once spent. If a narration fails outright, it isn't charged.
• Subscriptions are sold, billed, renewed and cancelled through the App Store or Google Play, under their terms. Cancelling is as easy as subscribing: use your store account's subscription settings. Refunds are handled by the store under its policies.
• We may change prices and allowances in the future with notice; credits you already hold keep their validity.

6. Acceptable use

Don't misuse AudioTales. In particular, don't use it to break the law or infringe anyone's rights; to make content that is unlawful, hateful, sexual or harmful, especially anything involving children; to interfere with or overload the service; to get around its limits or security; or to copy, resell or reverse-engineer it, except where the law allows. We may suspend or close accounts that do.

7. AI narration, and availability

Narration, transcription and translation are machine-generated and can contain mistakes — a misread word, an odd pronunciation, a loose translation. Please listen before you rely on them, and fix a page's words if needed. AudioTales depends on third-party services and may sometimes be unavailable or slow; we don't promise it will always be available or error-free.

AudioTales is provided “as is”. To the extent the law allows, we disclaim all warranties not stated in these terms, including fitness for a particular purpose and non-infringement.

8. Our liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, or for loss of data, and our total liability to you for any claim about AudioTales is limited to the amount you paid us in the three months before the claim, or US$10 if that is more. Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the law where you live.

9. Ending

You can stop using AudioTales at any time and delete your account — in the app (Profile → Delete account) or by asking us. We may suspend or end your access if you seriously or repeatedly break these terms, or if we stop providing AudioTales — in that case we'll give you reasonable notice where we can, so you can export your books' audio.

10. Changes to these terms

We may update these terms. If a change is significant, we'll give notice on this page, and in the app where we can, before it takes effect. If you keep using AudioTales afterwards, the new terms apply.

11. Law

These terms are governed by the laws of the State of Wyoming, USA, except where the law of the country you live in gives you protections that can't be overridden by agreement.

12. If you got AudioTales from Apple's App Store

These terms are between you and us, not Apple. Apple is not responsible for AudioTales or its content, has no obligation to provide maintenance or support for it, and — to the extent the law allows — has no warranty obligation for it beyond refunding the purchase price, if any, if AudioTales fails to conform to a warranty. We, not Apple, are responsible for addressing any claims relating to AudioTales, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims and intellectual property claims. You confirm you are not in a country subject to a US Government embargo or on any US Government list of prohibited or restricted parties. You must also follow any third-party terms that apply when using AudioTales. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
